Policy on Guaranteeing Equivalent Rights of Workers When Outsourcing Activities

Introduction

At Baku State University (BSU), we are committed to fostering a fair, safe, and inclusive working environment for all employees. Upholding labor rights, ensuring pay equity, and supporting professional growth are integral to our mission of promoting excellence in education, research, and social responsibility.


Scope

This policy applies to all full-time, part-time, and temporary employees, including faculty, administrative staff, researchers, student workers, and outsourced personnel at BSU.


1. Fair Compensation and Pay Equity

BSU’s Commitment:

  • Transparent Pay Structures: Compensation is based on qualifications, experience, and performance, without gender or nationality bias.

  • Regular Reviews: Pay scales are reviewed regularly to identify and eliminate gender pay gaps.

  • Commitment to Equity: BSU fosters an equitable work environment where all employees are fairly valued and rewarded.

Measuring and Tracking Pay Equity:

  • Data Collection & Analysis: Systematic collection of employee compensation data to monitor gender and equity-related trends.

  • Reporting & Transparency: Regular reports on pay equity are shared with stakeholders to ensure accountability.

  • Continuous Improvement: Identified disparities are addressed promptly to maintain fairness across all staff categories.


2. Freedom of Association and Union Recognition

BSU’s Commitment:

  • All employees have the right to form, join, and participate in labor unions or professional associations.

  • Union membership and participation are fully protected, including for women and international staff.

  • Constructive dialogue with recognized unions is encouraged to discuss employment terms, working conditions, and employee welfare.

Grievance Redressal & Appeals:

  • Employees have access to a formal grievance redressal mechanism to address concerns regarding rights, pay, or working conditions.

  • Appeals are handled with confidentiality and impartiality, and BSU provides guidance and support throughout the process.


3. Policy on Outsourced Activities

BSU ensures that employees of third-party contractors enjoy rights equivalent to directly employed staff:

  • Equal Rights & Fair Treatment: Contractors must provide fair wages, safe working conditions, and protection from discrimination.

  • Compliance with National Laws: All outsourcing agreements comply with Azerbaijani labor laws.

  • Monitoring & Evaluation: BSU monitors contractors to ensure adherence to these standards and addresses discrepancies promptly.


4. Non-Discrimination, Anti-Harassment, and Inclusivity

BSU maintains a zero-tolerance approach to discrimination, harassment, or retaliation in all forms, covering:

  • Recruitment, hiring, promotion, and professional development

  • Workplace interactions, compensation, and benefits

  • Activities in classrooms, labs, offices, events, and remote work settings

Employee Training:

  • Regular training is provided on diversity, equity, inclusion, and anti-discrimination policies to ensure all employees understand their rights and responsibilities.


5. Health, Well-being, and Career Development

  • BSU provides mental and physical health services, flexible work arrangements where feasible, and opportunities for professional growth through workshops and career advancement programs.


6. Legal and Ethical Framework

BSU aligns with national and international labor standards:

  • Constitution of the Republic of Azerbaijan (Article 35): Guarantees minimum wage rights.

  • Labour Code of Azerbaijan (Articles 155, 292, 296): Establishes fair labor practices, minimum wage, and employee rights.

  • Independent Trade Union of Azerbaijan Education Employees: Ensures union membership and collective bargaining protections.


7. Review and Continuous Improvement

  • The university regularly reviews and updates this policy to ensure relevance, effectiveness, and compliance with national laws and international labor standards.

  • Continuous monitoring, stakeholder feedback, and best practice adoption support an ongoing commitment to fair labor practices and employee rights.
